Your rights under Australian Consumer Law are not affected by these Terms
Nothing in these Terms limits, excludes, or modifies any right or remedy you have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded or limited. This includes your consumer guarantee rights to a remedy for goods that are faulty, not fit for purpose, or not as described. Those rights apply independently of these Terms.
1. About These Terms
These Terms and Conditions ("Terms") govern your access to and use of the Musos Corner website at www.musoscorner.com.au ("Website") and your purchase of products and services from Next Chapter Music Pty Ltd (ABN 90 675 443 866) ("Musos Corner", "we", "us", "our").
By accessing the Website or placing an order, you agree to be bound by these Terms. Please read them carefully before using the Website or making a purchase. If you do not agree to these Terms, you should not use the Website.
These Terms should be read together with our Privacy Policy, Price Match Policy and Returns Policy, which also apply to your use of the Website and are incorporated into these Terms by reference.
We may update these Terms from time to time. Where we make a material change, we will post a notice on the Website and update the "Last updated" date above. If you continue to use the Website or place an order after changes take effect, you will be taken to have accepted the updated Terms. We will not change Terms in a way that affects orders already placed.
2. Using Our Website
2.1 Access and availability
We provide access to the Website on a reasonable-efforts basis. We do not guarantee that the Website will always be available, uninterrupted, or error-free. We may suspend, withdraw, or restrict access to all or part of the Website for business or operational reasons. We will try to give you reasonable notice of any planned suspension.
We will not be liable to you if the Website is unavailable at any time, except where that unavailability results from our breach of a consumer guarantee under the Australian Consumer Law.
2.2 Acceptable use
You must use the Website only for lawful purposes and in a manner that does not infringe the rights of others. You must not:
- transmit or distribute any virus, trojan, worm, logic bomb, or other malicious or technologically harmful material
- attempt to gain unauthorised access to any part of the Website, its servers, or any server, computer, or database connected to it
- carry out a denial-of-service attack or distributed denial-of-service attack against the Website
- submit or transmit any content that is offensive, harassing, defamatory, obscene, or in breach of any law
- infringe any intellectual property rights of Musos Corner or any third party
- send any unsolicited commercial communications (spam) through the Website
- use automated tools to scrape, crawl, or copy content from the Website without our prior written consent
Breach of these acceptable use requirements may constitute a criminal offence. We will report any such breach to relevant law enforcement authorities and may disclose your identity to them. We may also immediately suspend or terminate your access to the Website.
We will not be liable for any loss or damage caused by a cyber attack, virus, or other harmful material that may affect your computer equipment or data as a result of your use of the Website, provided we have taken reasonable steps to protect against such events.
3. Intellectual Property
All intellectual property rights in the Website and its content - including text, images, graphics, logos, software, and other materials - are owned by or licensed to Next Chapter Music Pty Ltd and are protected by Australian and international copyright, trade mark, and other intellectual property laws.
You may view, print, and download content from the Website solely for your own personal, non-commercial use. You must not publish, distribute, reproduce, modify, or commercially exploit any content from the Website without our prior written permission.
Third-party trade marks, brand names, and product names displayed on the Website remain the property of their respective owners. Reference to any brand or trade mark on the Website does not imply endorsement of Musos Corner by that brand owner, nor any affiliation or association between Musos Corner and that brand owner.
4. Third-Party Websites and Links
The Website may contain links to third-party websites ("Linked Sites"). These links are provided for your convenience only. We do not control the content, privacy practices, or terms of Linked Sites and do not accept any responsibility for them.
A link to a Linked Site does not indicate any form of endorsement, approval, or affiliation by Musos Corner. Your use of any Linked Site is governed by that site's own terms and conditions and privacy policy, which you should read before using it.
5. Placing Orders and Formation of Contract
5.1 How orders work
When you place an order on the Website, you are making an offer to purchase the relevant products at the price and on the terms displayed at the time of your order. No contract is formed between us until we send you an order confirmation email ("Order Confirmation").
We reserve the right to decline any order at our discretion - for example, if a product is out of stock, if a pricing error has occurred (see clause 5.3), or if we suspect fraud. If we decline your order and you have already paid, we will issue you a full refund promptly.
The contract between us ("Contract") is formed on the terms set out in your Order Confirmation. Products not listed in your Order Confirmation are not included in the Contract.
5.2 Eligibility to order
To place an order you must:
- be at least 18 years of age, or, if you are under 18, have the consent of a parent or guardian who is at least 18 years of age and who agrees to be responsible for the order on your behalf
- provide accurate, complete, and current details including your name, delivery address, and payment information
- be the authorised holder of the payment method used
By placing an order you confirm that you meet these requirements. We reserve the right to cancel orders if we have reason to believe these conditions are not met, and to report suspected fraudulent activity to relevant authorities.
Some products may be subject to additional age restrictions under Australian law (for example, certain chemicals or restricted items). Where applicable, age restrictions will be displayed on the relevant product page.
5.3 Pricing and availability
We take reasonable care to ensure that prices and product descriptions on the Website are accurate. However, errors may occasionally occur.
Where a manifest pricing error has occurred - meaning the displayed price is below our cost price for the product, or is otherwise so clearly incorrect that no reasonable customer could have believed it was the price we intended - we reserve the right to refuse to confirm your order. No contract is formed in those circumstances (see clause 5.1) and we will issue you a full refund of any amount paid.
For other pricing errors that are not manifest errors, if we discover the error on an order you have placed we will contact you as soon as reasonably practicable and give you the option to:
- confirm your order at the correct price; or
- cancel your order and receive a full refund.
If we cannot contact you within a reasonable period, we will treat the order as cancelled and issue a full refund. In the rare event a pricing error is identified after goods have been despatched, we will contact you to discuss options and will not require return of the goods solely on the basis of the error.
Prices are displayed in Australian dollars (AUD) and include GST where applicable. Delivery charges are additional and will be clearly displayed before you complete your order and included in the total cost shown at checkout.
Product availability is not guaranteed. If a product becomes unavailable after you have placed an order, we will contact you to discuss your options, which may include a substitute product, backorder, or full refund.
5.4 Payment
Payment is required at the time of placing your order. We accept the payment methods displayed on the Website at checkout.
When you provide payment details, we carry out a standard authorisation check to confirm the validity of your payment method and that sufficient funds are available. Your payment method will be charged upon authorisation. Funds received are held as a deposit against your order until the goods are despatched, at which point the funds are applied as full consideration for the purchase.
We use third-party payment processors to handle transactions. We do not store full card details on our systems. Your payment information is handled in accordance with our Privacy Policy and the security standards of our payment processor.
If a payment is declined or reversed, we reserve the right to suspend or cancel your order and seek recovery of any amounts owed.
5.5 Special orders and deposits
A "Special Order" is an order for a product that we do not currently hold in stock and that we arrange to be supplied through our supplier network at your request. This includes signature models, custom configurations, made-to-order instruments, and items requiring direct procurement from a manufacturer.
Special Orders are subject to the following additional terms:
- A deposit of 40% of the total order value is payable at the time of placing the Special Order. Higher deposits may be required for custom-built or commissioned items, and will be quoted to you in writing before the order is placed.
- The deposit is refundable less reasonable costs incurred. Where you cancel your Special Order after we have placed the corresponding order with our supplier, the amount we may retain is limited to the reasonable costs we have actually incurred in connection with the order. Reasonable costs may include any non-refundable amount paid or committed to our supplier, any non-refundable freight, customs, or import charges, our staff time at our standard rate spent specifying, ordering, and communicating with the supplier, and any reasonable charge for receiving and restocking the item if it has already been delivered to us. Any portion of the deposit that exceeds our reasonable incurred costs will be refunded to you. We will provide a written breakdown of any amounts retained on request.
- Delivery timeframes for Special Orders are estimates only and are dependent on our supplier. If your Special Order is not delivered within 60 days of the original estimated delivery date, you may elect to cancel the order and receive a full refund of all amounts paid (including any deposit, and without any deduction for costs incurred under the clause above).
- Where commercially reasonable, we may at our discretion offer you a store credit equivalent to any amount otherwise retained from your deposit, in lieu of a cash retention.
- Special Orders are not eligible for change-of-mind returns under clause 7.3.
5.6 Lay-by
Musos Corner does not currently offer lay-by. Where you wish to secure a product in advance of full payment, please contact our team to discuss whether a Special Order arrangement under clause 5.5 may be appropriate.
5.7 Trade and credit account customers
If you hold a credit account or trade account with Musos Corner, your purchases are subject to our separate Trade Terms, which prevail over these Terms to the extent of any inconsistency. Schools, education institutions, and approved business customers should contact our team to discuss credit account eligibility and trade pricing.
6. Delivery
6.1 Delivery times and risk
We will use reasonable endeavours to despatch orders within the timeframe specified on the relevant product page or at checkout. Estimated delivery times are guides only and are not guaranteed.
Delivery is to the address you nominate at checkout. Subject to clause 6.2, risk in the goods passes to you on delivery. Title to the goods passes to you on receipt of cleared payment in full.
Where delivery is delayed due to circumstances outside our reasonable control (including extreme weather, carrier delays, natural disasters, pandemics, or industrial action), we will not be liable for that delay, but will take reasonable steps to keep you informed and complete delivery as soon as practicable.
6.2 Authority to Leave
If you select "Authority to Leave" (or any equivalent option) at checkout, you authorise the carrier to leave your goods at the nominated delivery address without obtaining a signature. In that case:
- delivery is deemed to have occurred when the carrier leaves the goods at the agreed location
- risk in the goods passes to you at the time the goods are left, including risk of theft, loss, or damage occurring after that time
- we are not responsible for the security of the goods after they have been left at the agreed location.
For orders with a total value above $500, we recommend you select a signature-required delivery option rather than Authority to Leave. This is a recommendation only; the choice of delivery method is yours.
Where a delivery attempt is made and you are not available and you have not provided Authority to Leave, we will follow our standard re-delivery process. If goods are returned to us as undeliverable after reasonable attempts to contact you, we may cancel the order and refund your payment less any reasonable delivery and handling costs incurred.
7. Consumer Guarantees, Returns and Remedies
7.1 Your rights under the Australian Consumer Law
Under the Australian Consumer Law, our products come with guarantees that cannot be excluded. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these Terms is intended to, or operates to, exclude, restrict, or modify any consumer guarantee, right, remedy, or liability under the Australian Consumer Law or any other applicable law that cannot lawfully be excluded.
7.2 Our returns and refunds policy
In addition to your statutory rights, we operate a returns and refunds policy described on our Returns page at www.musoscorner.com.au/returns. Our returns policy does not limit or replace your rights under the Australian Consumer Law. To initiate a return, please use our online returns portal (powered by Returns GO) accessible from the Returns page, where you can submit a return merchandise authorisation (RMA) request, upload supporting evidence, and track the status of your return. Alternatively, you may contact our support team using the details in clause 14.
If you believe a product you have received is faulty, not as described, or otherwise does not meet a consumer guarantee, please contact us using the details in clause 14 as soon as practicable. We will not charge a restocking fee, return freight, or any other handling charge in respect of goods that do not meet a consumer guarantee.
7.3 Change of mind
We are not required by law to accept returns or provide refunds where you have simply changed your mind. As a general policy, we do not accept change-of-mind returns.
At our discretion, we may agree to a courtesy return where you have changed your mind, subject to all of the following conditions:
- you notify us of your request within 14 days of receiving the goods
- the product is unopened, unused, and in its original packaging and pristine condition
- you are responsible for the cost of returning the goods to us
- original delivery charges are not refunded.
Courtesy returns under this clause are not available for Special Orders (clause 5.5), used, vintage or B-stock goods (clause 7.4), gift cards (clause 7.5), software, strings, mouthpieces, in-ear monitors, or other hygiene-sensitive items. This clause does not affect your rights under the Australian Consumer Law where the goods do not meet a consumer guarantee.
7.4 Used, vintage and pre-owned goods
We sell used, vintage, and pre-owned instruments and equipment alongside new stock. The following terms apply to those goods.
Consumer guarantees and quality standards
Consumer guarantees under the Australian Consumer Law apply to used, vintage, and pre-owned goods. The standard of "acceptable quality" is assessed having regard to the age of the goods, the price paid, and how the goods were described to you at the time of sale. Goods of significant age will not be expected to perform to the same standard as new equivalents.
Where used, vintage, or pre-owned goods are sold with known cosmetic or functional characteristics arising from age and prior use, those characteristics will be described in the listing. Where you have been made aware of a specific characteristic before purchase, the consumer guarantee of acceptable quality does not entitle you to a remedy for that characteristic.
Vintage instruments
"Vintage" instruments and equipment are those of significant age or collector interest - typically more than 20 years old - and are characterised by features such as period-correct components, original finish, and signs of use consistent with their age. We treat vintage stock with particular care:
- Each vintage instrument is individually photographed; product images shown online are of the actual instrument being sold, not stock or representative images
- Condition is described in detail, including known repairs, modifications, replaced parts, refinishes, and signs of wear
- Where we are aware that a component (for example, pickups, tuners, electronics, or finish) is not original or has been replaced or modified, that information is disclosed in the listing
- Where information about the instrument's history, originality, or provenance is uncertain or unverifiable, that uncertainty is stated rather than implied to be confirmed
Authentication and provenance
We rely on the experience of our team and, where appropriate, manufacturer documentation, serial number registers, and external specialist advice to form a reasonable view about the year of manufacture, originality, and provenance of vintage instruments. Statements we make about year, originality, or provenance reflect our reasonable belief based on information available to us at the time of sale. We do not warrant authenticity or provenance beyond that reasonable belief. Where you require independent appraisal, we recommend you obtain it before completing your purchase.
In-store inspection
Vintage instruments may be inspected at our store before purchase. We strongly recommend in-store inspection for any vintage purchase, particularly for purchases above $5,000. Where you have indicated serious interest in a vintage instrument, we may agree to hold it for inspection for a defined period on receipt of a refundable holding deposit.
Sound, feel, and other subjective qualities
A vintage instrument's tone, weight, balance, neck profile, and similar subjective characteristics are part of what makes each piece individual. Differences in these qualities from your personal expectations or preferences are not a failure to meet a consumer guarantee and are not grounds for return.
Returns and remedies
Used, vintage, and pre-owned goods are not eligible for change-of-mind returns under clause 7.3. Your rights under the Australian Consumer Law (including in respect of a major failure such as an undisclosed structural defect or a substantial misdescription) apply in full.
7.5 Gift cards
Musos Corner gift cards may be purchased and redeemed at our store and on our website. Gift cards are valid for at least 3 years from the date of purchase, in line with federal gift card law. Gift cards are not redeemable for cash and cannot be used to pay for further gift card purchases. We may, at our discretion, replace a lost or stolen gift card if you can produce proof of purchase and the card has an unredeemed balance. Change-of-mind returns are not available on gift cards.
8. Luthier Services
We provide luthier services including setup, repair, restoration, modification, and customisation of stringed instruments. The following terms apply to all luthier services we provide on customer-owned instruments.
8.1 Quotes and authorisation
Before commencing work, we will provide you with a written quote based on the work you have requested and our initial inspection of the instrument. The quote is an estimate based on the information available at that time.
If, in the course of work, our luthier identifies additional work that would cause the total cost to exceed the original quote by more than the lower of $100 or 20% of the quoted amount, we will stop work and contact you for written authorisation (by email, SMS, or in-store signature) before proceeding. We will not commence the additional work until we have received your authorisation.
If you do not authorise the additional work within 14 days of being contacted, you may collect your instrument on payment of any work already authorised and completed.
8.2 Insurance and risk
While your instrument is in our possession for luthier work, we hold it as a bailee for reward.
Our business insurance covers customer-owned instruments held on our premises for the purpose of luthier services, up to a value of $5,000 per instrument.
Cover above $5,000 per instrument is your responsibility. Where your instrument has a value in excess of $5,000, we recommend you maintain your own insurance covering loss or damage to the instrument while it is in our possession.

Nothing in this clause limits our liability for loss or damage caused by our negligence or in breach of the Australian Consumer Law.
8.3 Collection and storage
Once your luthier work is complete we will contact you using the details you provided at intake. You should collect your instrument within 14 days of being notified that work is complete.
If the instrument is not collected within 14 days, a storage fee of $10 per week, or part thereof, will apply until collection. Storage fees must be paid before the instrument is released.
8.4 Uncollected goods
If your instrument remains uncollected, the following process will apply under the Uncollected Goods Act 1995 (NSW):
- Day 60 from initial completion notice: we will send a second notice by registered post or comparable signed-for delivery service
- Day 90: where storage charges remain unpaid, we will issue a formal notice under the Act, advising that we intend to sell the instrument if it remains uncollected and unpaid for
- Day 118 (or as required by the Act): we may sell the instrument by public auction or as otherwise permitted by the Act
- the proceeds of sale will be applied first to outstanding storage and service charges, with any balance held for you for 12 months from the date of sale; thereafter any unclaimed balance may be retained by Musos Corner.
Nothing in this clause limits any additional rights or obligations of either party under the Uncollected Goods Act 1995 (NSW).
9. Trade-Ins
From time to time we accept customer-owned musical instruments and equipment as trade-ins toward the purchase of another item from us. Trade-ins are only available at the point of sale of a new or used item from Musos Corner: trade-in value is applied as a deduction from the purcha
